opportunity to assist you, and look forward to helping you make your Vacation
at Sunset Beach a most enjoyable experience.
GENERAL
I, the tenant, understand that this home is privately owned, and The
Odom Company must reserve the right to refuse occupancy if they feel that
occupancy is detrimental to the best interest of the owner. I understand
that any damage done to the home during my occupancy is my responsibility,
and I agree to leave the home clean and in good order. NO PETS OF ANY
KIND ARE PERMITTED ON THE PROPERTY. YOUR CANCELLED CHECK IS YOUR RECEIPT.
WE DO NOT ACCEPT CHARGE CARDS. WE WELCOME CASH, TRAVELERS CHECKS,
OR PERSONAL CHECKS.

CANCELLED THANK YOU.
CHECK-IN PROCEDURES:
- Check-in time is 3:00 P.M. or later between Memorial & Labor Day.
We can be somewhat flexible during the off-season, if prearranged.
- No pets. No
houseparties. You must be at least 21 years of age to rent with
us, but being 21 or older does not exempt you from being considered
a houseparty. We have the final say as to what is a houseparty.
- Linens and towels
are not furnished, but are available for rent.
- Please report
any problems to us as soon as you check in, or as soon as they occur.
We have service people available every day. We cannot make refunds nor
adjustments for appliance or systems malfunctions.
- Please do not
make long-distance calls that cause costs to be charged to the homeowner’s
telephone. A $25 handling fee will be charged to you, in addition to
the long-distance costs. The only exchanges that are local calls from
Sunset Beach are 579, 575, 754, 755, 842, 845, 846, 253 & 287.
- There will be
a $25 charge on all returned checks.
- If circumstances
require, we reserve the right to substitute a comparable property. If
at time of tenancy we cannot provide the property or reasonable substitute
property in a fit and habitable condition we will provide a refund.
- If you cancel a
reservation, we will refund your advance rent, less a 15% cancellation
fee, provided we are able to re-rent the home for the specific time
period originally rented. If not, no refund will be made.
CHECK-OUT PROCEDURES:
- Check-out time is before 11:00 A.M. during the summer. “Check out”
means that all guests, personal property and vehicles are off the property
and keys have been turned in to the Odom Co. We can be somewhat flexible
during the off-season, if prearranged.
- Guests are responsible for providing their own cleaning products,
and for thoroughly cleaning the home prior to departing. We do provide
housekeeping service for a fee, and you may arrange for this service
through our office. Our housekeeping contract requires you do certain
things, so please be sure you understand your obligations. Payment to
us to do housekeeping does not mean you can abuse the house.
- All keys, rental linens and towels are to be returned to us upon departure.
Rental cribs and highchairs are to be left in the house for us to pick
up.
- Lock all doors and windows, cut all interior and exterior lights
off, and set the air or heat on a conservative setting.
OCCUPANCY CONSIDERATIONS:
EACH HOME AT SUNSET BEACH HAS ITS OWN INDIVIDUAL IN-GROUND SEPTIC SYSTEM
FOR WASTE DISPOSAL. OUR COUNTY HEALTH DEPARTMENT IMPOSES A CONTINUOUS
OCCUPANCY LIMITATION ON EACH HOME OF 2 PERSONS PER PERMITTED BEDROOM.
PLEASE MAKE THIS A PRIMARY CONSIDERATION IN YOUR SELECTION PROCESS.
VACATION RENTAL
ACT (NC GENERAL STATUTES SECTION 42A-1)
This is a vacation rental agreement under the NC Vacation Rental Act (VRA).
Rights and obligations of the parties to this rental agreement are defined
by law and include unique provisions permitting disbursement of rent prior
to tenancy and expedited eviction of tenants. Your signature on this rental
agreement, payment of money, or taking possession of the property after
receipt of this agreement is evidence of your acceptance of this agreement,
and of your intent to use this property for a vacation rental.
The Odom Co. is a
management firm that, on behalf of the owner of the property and as a
representative of the interests of the owner, rents the property subject
to the provisions of this rental agreement. Rent monies are held in an
interest-bearing trust account at Centura Bank, Calabash, NC, with accrued
interest being the property of The Odom Co. Funds (to include advance
rent, sales/accommodations/other taxes) are subject to disbursement from
this account at commencement of tenancy, material breach of the agreement
by the tenant, or monies that may be refunded to the tenant.
If Local or State
authorities order mandatory evacuation of the island of Sunset Beach (such
as hurricane evacuation), and the tenant complies with the order, The
Odom Co. will refund prorated rent for each night of the evacuation order.
The VRA provides for
expedited eviction of tenants of less than 31 days in the event a tenant
fails to pay rent as required by this rental agreement, obtains possession
of the property by fraud or misrepresentation, holds over after expiration
of tenancy, or commits a material breach of the rental agreement that
results in the termination of tenancy.
This rental agreement
is a legally-binding agreement, and in the event of dispute, will be interpreted
in accordance with NC law, and legal action may be instituted only in
the county in which the property is located. The management company and
owner of the home are indemnified and held harmless against any liability
for personal injury or property damage sustained by any person, including
guests of the tenant, as a result of any cause, unless by negligent acts
of the management company or owner of the home. Representatives of the
management company have the right to enter premises during tenancy to
do needed or preventative maintenance.
The lease and the
current Odom Co. Rental Brochure comprise the total rental agreement.
